About the Client

Nochumson P.C. represented the owner of a historic commercial building located on North Broad Street in Philadelphia after a major weather event caused a portion of the building’s brick façade to collapse.

The Challenge

Following the weather event, the property sustained extensive damage to the front façade, resulting in repair costs totaling several hundred thousand dollars.

When the client submitted a claim under the applicable insurance policy, the insurance carrier denied coverage for the loss.

As a result, the client faced the prospect of funding the substantial repair costs independently unless legal action was taken to enforce the policy obligations.

The Solution

Nochumson P.C. promptly filed litigation against the insurance carrier alleging breach of the insurance policy and seeking a judicial declaration requiring coverage for the repair costs associated with the damaged façade.

The matter was later removed to federal court based upon the amount in controversy and the parties’ business locations.

Throughout the litigation, Nochumson P.C. conducted extensive discovery, pursued motion practice, and prepared the matter for trial in order to challenge the insurance carrier’s denial of coverage.

Commercial property insurance disputes often turn on detailed policy interpretation, factual investigation, and strategic litigation regarding the scope of covered losses.

The Results

On the eve of trial, the insurance carrier agreed to resolve the litigation and pay nearly the full amount sought by the client for the repair of the building façade.

The settlement allowed the client to proceed with restoration of the historic commercial property while avoiding the uncertainty of trial.
