About the Client

Nochumson P.C. represented a Philadelphia real estate developer seeking approval to construct a single-family residence with off-street parking on a vacant lot in Fairmount.

The Challenge

The proposed development included a front-loading garage, which was prohibited under the Philadelphia Zoning Code and required a zoning variance from the Zoning Board of Adjustment.

Nearby property owners also raised concerns regarding the potential impact of the proposed structure on light, air, and neighborhood character.

The matter therefore required both legal zoning representation and strategic community outreach before the zoning hearing could proceed.

The Solution

After receiving the Notice of Refusal from the Department of Licenses and Inspections, Nochumson P.C. filed an appeal with the Philadelphia Zoning Board of Adjustment seeking approval for the proposed development.

The firm argued that the proposed curb cut would not reduce available street parking because parking was already prohibited in front of the property.

Nochumson P.C. also highlighted similar nearby properties that previously obtained approval for comparable off-street parking arrangements under similar conditions.

Rather than waiting until the public hearing to address opposition, the firm coordinated direct meetings between the developer and neighboring property owners to discuss concerns regarding the project’s design and impact on surrounding properties.

Those discussions ultimately resulted in support from nearby residents and strengthened the presentation before the Zoning Board.

Community outreach and precedent involving nearby approved developments can play an important role in obtaining zoning variances in Philadelphia neighborhoods.

The Results

The project received strong community support, including backing from the neighboring property owners most directly impacted by the proposed development.

The Philadelphia Zoning Board of Adjustment ultimately voted unanimously to approve the requested zoning variance, allowing the project to move forward.
