About the Client

Nochumson P.C. represented a real estate developer seeking to convert a parcel of land in Brewerytown into a 20-unit planned community designed for residential homeownership and shared off-street parking access.

The Challenge

The project required a zoning variance from the Philadelphia Zoning Board of Adjustment in order to permit construction of the proposed 20-unit development on the uniquely configured parcel.

Beyond the zoning approval process, the development also required significant legal coordination before the units could be marketed and sold individually. This included obtaining separate tax identification numbers for the units, establishing access easements throughout the property, creating a homeowner’s association, and preparing the planned community documentation governing ownership and operation of the development.

The developer also needed to ensure that prospective purchasers received the disclosures and governing documents required for the lawful sale of the units.

The Solution

Nochumson P.C. assisted the developer in obtaining tax identification numbers for each unit through the City of Philadelphia’s Office of Property Assessment before preparing and recording easement agreements governing pedestrian and vehicular access throughout the property.

The firm also established the homeowner’s association for the planned community by preparing and filing the necessary incorporation documents with the Pennsylvania Department of State.

In connection with the sale of the units, Nochumson P.C. prepared the public offering statement for the planned community, including the declaration creating the separate units, the homeowner’s association bylaws, the rules and regulations governing the community, the proposed association budget, and disclosures outlining the rights and obligations of both the developer and prospective unit owners.

The Results

After the planned community structure and governing documents were completed, the developer successfully sold all 20 residential units within the project.

The completed development ultimately generated nearly $10 million in unit sales.
