About the Client

Nochumson P.C. represented a Philadelphia real estate developer seeking to acquire and develop a portion of a commercially used property into a 24-unit residential planned community.

The Challenge

The proposed development required subdivision of the existing property into separate parcels before construction could move forward.

Although the proposed residential use itself was permitted under the Philadelphia Zoning Code, the planned community design triggered several dimensional zoning variances requiring approval from the Philadelphia Zoning Board of Adjustment.

The project also faced community concerns relating to traffic flow and public safety tied to the configuration of the proposed common driveway.

The Solution

Nochumson P.C. guided the client through the zoning and subdivision approval process, coordinating with surveyors, architects, and city agencies throughout the project.

After the Department of Licenses and Inspections issued a Notice of Refusal based upon dimensional variance issues, the firm filed an appeal to the Philadelphia Zoning Board of Adjustment seeking approval for the proposed development.

During the community outreach process, Nochumson P.C. worked with the client to revise portions of the planned community layout, including redirecting traffic flow to better address neighborhood concerns.

The community ultimately supported the revised proposal, and the Zoning Board of Adjustment unanimously approved the zoning appeal.

Following zoning approval, Nochumson P.C. also handled the subdivision process, including obtaining new tax parcel numbers and preparing the deed of subdivision used to complete the property transfer at closing.
